Ohio's autism insurance mandate requires state-regulated health plans to cover the screening, diagnosis, and treatment of autism spectrum disorder for ages 0 to 21, and that includes ABA.

The law is House Bill 463, passed in 2017 and written into the Ohio Revised Code at 1751.84. The exception is the part worth reading twice.

The one question to ask HR

Ohio can only regulate insurance that Ohio regulates. Large employers often self-fund their health plans, which puts them under federal law instead. The state mandate doesn't reach them.

Plan type

Does Ohio's mandate apply?

Fully insured plan regulated by Ohio

Yes

Self-funded employer plan

No. It follows federal rules instead.

Ohio Medicaid

Different track. Covered to 21 under EPSDT.

Ask HR one question: is our health plan fully insured or self-funded? Your insurance card won't tell you, and the answer decides whether the Ohio mandate is on your side.

A self-funded plan isn't automatically bad news. Plenty of them cover ABA well, voluntarily. It just means the mandate isn't what's forcing them to.

About that 20 hour cap

You'll see it written that Ohio limits ABA to 20 hours a week. That number appears in the mandate, but a hard cap on autism treatment runs into the federal Mental Health Parity and Addiction Equity Act.

Parity law says a plan can't put tighter limits on mental health and behavioral care than it puts on medical care. A flat weekly ceiling on ABA, with no equivalent ceiling on physical therapy, doesn't survive that test.

In practice, hours come from the clinical assessment. If a plan quotes the 20 hour figure as a hard stop, that's worth pushing back on with your BCBA's documentation.

Frequently Asked Questions

What if our plan denies ABA?

Ask for the denial in writing and the specific reason. Most denials are about clinical documentation, not coverage. A BCBA can usually answer them directly.

Our child turns 21 soon. What then?

The mandate runs to 21, and so does Medicaid EPSDT. Planning the transition ahead of that birthday is a lot easier than sorting it out afterward.

Can someone just check our plan for us?

Yes. Achieving Stars Therapy runs a free benefits check, confirms coverage before the first session, and handles prior authorization.
